EULA - End User License Agreement

License

1. Under this End User Agreement (the Agreement), Training Games Inc. (the Vendor) grants to the user (the Licensee) a non-exclusive license (the License) to the Presentation Companion (the Software).

2. By installing, copying, or otherwise using the Software, you agree to be bounded by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

3. The Software includes the executable computer programs and any related printed, electronic and online documentation and any other files that may accompany the product.

4. Title, copyright, intellectual property rights and distribution rights of the software remain exclusively with Training Games Inc., the Vendor. Intellectual property rights include but are not limited to any images, photographs, clipart, libraries, as well as the look and feel of the Software. This Agreement constitutes a license for use only and is not in any way a transfer of ownership rights to the Software.

5. The Licensee is prohibited by this Agreement in regard to the sale of this Software in any manner what so ever and without exception.

6. The Software is offered free of charge by the Vendor, and may only be offered free of any charge, remuneration or compensation by the Licensee to other persons. This Agreement is in effect for any and all persons, legal entities, corporations or other organizations the Software is distributed to or shared with. It may be distributed freely and ONLY at no charge on any reputable website as long as no part of it is changed in any way.

7. The Software may be loaded on to multiple computers however this License will be consider to be in full effect for any computer this Software is installed on.

8. The Software may not be modified, reverse-engineered, or de-compiled in any manner through current or future technologies.

9. The Software is licensed as a single product. Its component parts may not be separated for use on more than one computer.

10. Failure to comply with any of the terms of this agreement under the License section of this document will be considered a material breach of this Agreement.

11. Without prejudice to any other rights, Training Games Inc., Vendor of this Software may terminate this End User License Agreement at their discretion or if you in any manner fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software and all of its component parts.

12. NO WARRANTIES.
The Author of this Software expressly disclaims any warranty for the Software. The Software and any related documentation is provided as is without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose. The entire risk arising out of use, installation or performance of the Software remains with you the Licensee.

13. NO LIABILITY FOR DAMAGES.
In no event shall the author of this Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Training Games Inc. the Vendor for this Software is aware of the possibility of such damages and known defects.
